A 24-year-old man accused of shaking his baby to death appeared before a judge Wednesday for a probably cause hearing.
Darius Smith was arrested and charged with capital murder in the October 2007 death of his son, Zion Smith, investigators said.
When Smith had called emergency personnel, he said his son collapsed to the floor and died. But investigators say they think Smith became so enraged when the child had a bowel movement on the floor, that he shook him so hard, causing what the medical examiner called trauma to the brain.
While investigating Zion’s death, detectives found another case where Smith’s other son, Marco Smith, who was 5 months old, died while in his father’s care. However, no criminal charges were able to be filed in this case.
