SAMSUNG ORDERED TO END SALES OF GALAXY TAB 10.1 IN US!

U.S. District Judge Lucy Koh has approved Apple’s request for a preliminary injunction in the U.S. against Samsung’s Galaxy Tab 10.1.

“Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products,” Koh wrote on Tuesday.

Apple filed a motion for a preliminary injunction in May 2012, claiming Samsung’s Galaxy Tab 10.1 infringes on an iPad-related patent. Apple has also filed a similar motion against Samsung’s Galaxy S III in June.

The judge’s order becomes effective after Apple posts a $2.6 million bond as protection against damages suffered by Samsung if the injunction is later overturned.

It’s important to note, however, that this ruling only affects Samsung’s older 10-inch tablet, the Galaxy Tab 10.1. It does not affect the updated Tab 10.1 II, which was unveiled in May 2012.

This is a press release I received from the attorney who represents James Fortune’s stepson.  He’s the victim in this case:

It has come to my attention that James and Cheryl Fortune have resorted to witness tampering by picking up the victim, the subject of the impending lawsuit, from the maternal grandmother (without the father’s knowledge or permission); taking him to their attorney’s office and having the minor victim sign a statement purportedly contradicting the facts in this case; and then returning the child to the maternal grandmother before the father arrived to retrieve his son.

At no point was the father advised of the activity. What is most troublesome about these recent actions, is that their lawyer should have known her own conduct violates the Texas Disciplinary Rules of Professional Conduct, Section 4.02, which prohibits a lawyer from “communicating or causing another person to communicate about the subject of representation with a person the lawyer knows to be represented by another lawyer without the consent of the other lawyer”.

Neither I, nor my client’s father (his legal guardian and representative for purpose of this law suit), were contacted by the Fortunes or their counsel with a request to interview my client about this matter. It is my firm belief that these actions are not only a violation of the Texas Penal Code, Section 36.05, but also the Texas Disciplinary Rules of Professional Conduct.

As such, I will be asking the proper authorities to investigate these actions for criminal charges and professional sanctions. It is hoped that in the future, the Fortunes and their counsel will contact my office when attempting to question my client about this matter and comply with the rules of procedure.

Sadly, James and Cheryl’s actions are indicative of the manipulation, intimidation, control and confusion that they have perpetrated on my client since his was a young child and further illustrates the merits of our case. The enclosed sworn physician’s statement is only a fraction of the evidence that detail the injuries suffered by client.

Background: James Fortune was arrested and received deferred adjudication for physically abusing his stepson back in 2001 according to court records. 

That son, who is now 15, was beaten and submerged in a tub full of hot water according to the civil lawsuit filed by the son’s biological father.

Note: I’m hoping to get a response from Fortune and his attorney as soon as possible.

Gospel singer James Fortune is facing major turmoil this week.  He was slapped with a civil lawsuit saying he brutally abused his stepson by beating the then 4 year old and holding him down in a tub of hot water.  The child sustained burns to 47% of his body in 2001. According to the lawsuit Fortune’s stepson now requires plastic surgey at the age of 15 years old.  But this legal action happened just days before Fortune and his group Fiya are up for a major award on the BET Awards in Los Angeles which airs July 1st.

“Several months ago I received a demand for payment from my stepson’s father for an injury to my stepson that occurred in 2001.  In the midst of negotiating a settlement regarding that injury, I was served with a lawsuit and now my wife and I are defending ourselves in civil court. At no time in my life was I convicted of felony injury to a child.  Following my step-son’s injury, there was a criminal investigation and all matters were resolved.  Since that time, my family and I, including my stepson, have maintained a continuous loving family environment.  Although his father has maintained custody, Cheryl and I have enjoyed continuous uninterrupted open visitations with my step-son since 2001.

We are shocked by this lawsuit but understand people are free to use the court system to pursue matters, whether or not the claims are baseless. We are confident through this process, the ultimate decision maker will render an outcome that is just and fair. We believe in our American justice system and know that once all facts are made transparent justice will prevail in our favor.

This lawsuit is a direct result of our desire to continue the uninterrupted love, commitment and financial support as well as to protect the ongoing wellbeing while enhancing the current living conditions of our son. We have given our stepson who is currently in our care during his summer break continuous support and understand these allegations are a direct result of not only our increased profile and financial viability but an individuals desire to exploit such.

We intend to vehemently defend our right to protect our family while maintaining the character integrity and trusted core values the Fortune family has been blessed to exemplify.”

SAMSUNG’S BIG DEBACLE!

There are millions of angry Samsung cell phone customers across the country. 

Check any chat board and you’ll find people ranting and raving about their missing Galaxy S 3.

The cell phone was scheduled for release on June 21 but because of the overwhelming demand it has been delayed for many US carriers like Sprint.

Those who preordered the phone may or may not have their devices in hand just yet. 

But here’s the crazy part…I went to the Best Buy in the Woodlands, Texas and I was told by a rep they have the phones in stock.  

However, he says he received an email from Samsung telling them not to sell them yet. 

What? So, you know you have a huge demand but you have a retailer sitting on phones?  It defies logic.

I also went to a Sprint store and they said they have no clue when the hot phone will be released in stores.  That’s despite sales personnel from the company saying it would be  out this Friday just last weekend.

As many of you know it was Monday when FOX 26 News reported award winning gospel singer James Fortune was sued.

The suit claims he physically abused his stepson back in 2001 by putting the then 4 year old in a tub of hot water. Fortune through his attorney issued this statement to the Insite at midnight:


I recently became aware of a civil suit pending against my wife, Cheryl Fortune and I, for an incident that occurred in 2001 involving my stepson. There was a criminal investigation and all matters were resolved in 2003. Since that time, my family and I, including my stepson, have continued with family traditions and always have a loving family environment. We are shocked by this lawsuit but understand people are free to use the court system to pursue claims, whether they contain merit or baseless matters. We are confident through this process, if it proceeds to a judge or jury, the ultimate decision maker will render a decision that is favorable to the circumstances and timing surrounding this situation. We believe in our American justice system and know it will work for us as it has for millions of other Americans.

Dozens of people came together last Thursday night at the National Association of Black Journalists convention in New Orleans.

The focus was Southern University.

Johann Calhoun organized a reunion of sorts that also paid tribute to students and staffers at the Baton Rouge school.

PASTOR ROBERT JEFFERSON DIES!

The founding pastor of Cullen Missionary Baptist Church has died. 
That man is Rev. Robert Jefferson.

Those close to the Louisiana native say he died Thursday morning while on a business trip to St. Louis, Missouri.

Jefferson has also been a longtime and outspoken member of Houston’s Ministers Against Crime.

The 70 year old’s cause of death has not been released.

Bio:

Reverend Robert C. Jefferson, was born in Baton Rouge, Louisiana, to the late James Mack Jefferson, Sr. and Lola Mae Hayes Jefferson. He is the proud father of four girls—Lola Denise Jefferson, Vanessa Jefferson Auguillard, Lisa Jefferson, and Robertine Jefferson. He has four grandchildren — LeKisha Hyman Jefferson Tate, Ronald Dale Jefferson, Jovonna Auguillard, Joseph Robert Auguillard and Charlette Aalyze Jefferson; and three great-grandchildren— Joshua White, Faith White, and DeShanae White.Pastor Jefferson accepted his calling into the gospel ministry in March 1976 and was ordained at Mount Horeb Baptist Church under the pastoral leadership of the late Reverend Johnnie Jones. In March 1977, he founded Cullen Missionary Baptist Church and has faithfully served ever since.  Pastor Jefferson is truly compassionate and committed when it comes to serving the Lord. His vision and mission to make life better for others through the Word of God has led him to take his ministry from beyond these four walls and out into the community, city, and the United States. He is the Founder/President of A Brand New City, Inc., Founder/President of Cullen Missionary Baptist Church Senior Citizens Ministry, Founder/President of Cullen Christian Child Development Center, and one of the founding members of Ministers Against Crime. He was also the founder of Sunnyside Up, Inc., a community development project. He currently serves as Second Vice President and the Director of Religious Affairs of the NAACP Houston BranchPastor Jefferson’ faith in God has kept him on the battlefield and he is Still Pressing On in the name of the Lord.   In March of 2010, he married Sis. Myrtle Lewis, a long standing and devoted member of Cullen. We pray that God will continue to shower His richest blessings down upon him so that he can be the great leader that he has been called to be.
