Family members of 19 year old Russell Rios are asking federal and state investigators to probe his death.
The now deceased bank employee was accused of trying to steal out of a Conroe Walmart in July.
That’s when investigators say an off duty Conroe police officer confronted him after store employees attempted detain the suspected shoplifter.
According to detectives there was a chase and Rios was eventually shot and killed outside the store in a wooded area by the police officer who said the 19 year old tried to choke him.
Rios’ father says his son was shot in the back of the head by the officer and he doesn’t believe his son was stealing.
Juan Cuyun also says he wants the state or the FBI to investigate the case instead of the Conroe Police department.
Attorneys representing the Rios family also plan to file a civil suit in this case.
Ryan MacLeod of Bernsen Law out of Beaumont also marched with the family Monday to the Montgomery County District Attorney’s office demanding an independent investigation.
