Family members of 19 year old Russell Rios are asking federal and state investigators to probe his death.

The now deceased bank employee was accused of trying to steal out of a Conroe Walmart in July.

That’s when investigators say an off duty Conroe police officer confronted him after store employees attempted detain the suspected shoplifter.

According to detectives there was a chase and Rios was eventually shot and killed outside the store in a wooded area by the police officer who said the 19 year old tried to choke him.

Rios’ father says his son was shot in the back of the head by the officer and he doesn’t believe his son was stealing.

Juan Cuyun also says he wants the state or the FBI to investigate the case instead of the Conroe Police department.

Attorneys representing the Rios family also plan to file a civil suit in this case.

Ryan MacLeod of Bernsen Law out of Beaumont also marched with the family Monday to the Montgomery County District Attorney’s office demanding an independent investigation.

    Lets say that he “was” stealing? What in that store is worth killing him for? The young man didn’t have a gun so how was he attempting against the officers life? If he was shot in the back of the head, could he not have been restrained? It’s just not making sense. What a sad situation. My condolences to the victims family.

    I agree with you Diana Rodriguez. The story doesn’t add up. What motive would you have to shoot someone from behind, especially on the head? How would the guy be choking the officer if he was facing the opposite direction? My condolences to the family and that they find their justice.

    This is such crap and each and every day people who steal lie and cheat get away with whatever they want while the people who do right get shafted. Yes this family says that there son is a prefect angle and would NEVER shop lift or fight a cop. Whatever! How many kids are on drugs and then end up going to the hospit, picked up by EMS, or law engorcemen; have blood work done and still denie that their child is anything less than a saint. It’s crap! Just like travon crap poor kid gets shot for doing nothing at all just being perfect and minding there own business. It’s okay to grieve and my heart goes out to the family of both parties bc both are suffering. All these riots and what not happening for these “perfect poor young adults” is rediculois. Here’s an idea just get rid of law enforcement and all other public servers jobs and let the public deal with their own crap and let’s see how they feel and how this are handled. Why not let the cartel run things. I’m sure that would be way better. Oh yes and by the way Wal mart said the guy was stealing and he ran from them when they tried to make him stay so if he didn’t do anything then why the heck did he run? Wake up world and parents how about being parents not friends, hold ur kids accountable.

    So sorry for the Rios’ family loss. Sounds like he was just starting his life! He was shot in vain. I pray this family gets justice!
