The Harris County Sheriff’s Office Homicide Unit is investigating the deputy involved shooting that occurred Wednesday, April 9, 2014, in the 17000 block of Scuttle Way in north east Harris County.

According to investigators, sheriff’s deputies were at the residence attempting to serve an arrest warrant for 47 year-old Michael Mitchell (DOB 07/25/66).

While deputies were in the residence, Mitchell became very uncooperative and refused to comply with the commands.

Mitchell then fled the residence out a backdoor. As he was trying to flee through a side gate, a deputy ordered him to stop.

The deputy observed that Mitchell appeared to have a pistol in his hand. He ordered him to drop the weapon.

Mitchell then turned and ran back towards the backyard.

Deputy L. Medina, a 13 year veteran of HCSO ordered him to stop and drop the weapon.

Mitchell refused all commands and Deputy Medina, fearing for his life and of his fellow deputies, discharged his weapon, striking Mitchell.

He was then immediately taken into custody.

Mitchell was transported to Memorial Hermann Hospital Medical Center by LifeFlight in critical condition.

He is charged with aggravated assault on a public servant.

HCSO Internal Affairs and Office of Inspector General will investigate this incident.

The Harris County District Attorney’s Office will also conduct an independent investigation of the event.
