Hearing has been postponed!
Since District Judge Kelly Case was elected in Montgomery County in 2012 he has been bumping heads with the District Attorney and his prosecutors.
Now, it has all come to a head with the D.A.’s attempt to get Case removed from the Adrian Peterson case.
Peterson was indicted last month after investigators say he went too far disciplining his 4 year old son.
Wednesday D.A. Brett Ligon made it clear he wanted Case off the case.
He says the Judge called him and Peterson’s defense attorney ‘media whores’ in a staff meeting last week.
The county’s top prosecutor also says the Judge has a personal bias and prejudice concerning a party to the proceeding.
Meanwhile, the Factor has learned subpoenas are now going out for the Friday morning recusal hearing in Conroe.
We’ve also confirmed Montgomery County defense attorney Rick Brass has been called to testify in the proceedings.
Brass will likely support Judge Case because he told the Factor before he was subpoenaed the District Attorney’s office is looking for anyway to publicly embarrass Judge Case.
