Donald Collins will know next week if statements he made when he was 13 years old will be used against him in his own trial.

Monday Montgomery County Judge Kathleen Hamilton will rule if the written statement made to investigators will be used in Collins’ murder trial.

It was back in 1998 when Collins was accused of setting Robbie Middleton on fire during a sexual assault.

Middleton died 13 years later as a result of the injuries he sustained from his attack according to the Montgomery County District Attorney’s office.

Collins’ attorney maintains his client did not have the mental capacity back then to give the stayement.

His trial is set to begin February 2nd in Galveston County.
