Prairie View police officer Michael Kelley was booked into the Waller County jail just after 9 pm Monday night.

He was arrested on a charge of official oppression after the October 2015 tasing and arrest of Prairie View City Councilman Jonathan Miller.

The Waller County grand jury returned the indictment Friday after members of the panel said officer Kelley had ‘no lawful reason’ to arrest Miller.

He was released on a $3,000 personal recognizance bond according to the Waller County Sheriff’s office.

Miller was cleared Monday of his initial arrest charges by the Waller County District Attorney’s office.

There’s no word yet when Kelley will make his first court appearance.

In the meantime, Chief Larry Johnson with the Prairie View Police Department says Kelley has been relieved of duty.

    That is just not right we all know they’re just throwing the racial card I have watched the video that man Jonathan Miller is only getting by with it because he’s a councilman I looked up his Facebook before he erased all the pictures of him with doing drugs and selling drugs I will gladly send you all the photos of it I saved them all

      What does that have to do with him getting tased? If they didn’t have a case against the officer then he wouldn’t have been indicted and his other charges wouldn’t have been DISMISSED! I watched several of the videos also. This officer needed a card to recite this man his Miranda rights. Plus, the officer lied. See what happens when people lie!

    It clearly shows were Officer Kelly was in the right that Jonathan Miller was resisting and not following the officers orders

    No law reqson means no lawful reason. Just because an officer has the “color of law” does not give him the right or authority to do whatever he likes. And to your point about his facebook page, whatever was on his page, from the past i might add, has no bearing on what the officer did on that night. It might also interst you to know that prior acts are not admissible in a court of law. Lets see some of your prior acts out of context with no further information and allow people that know less than nothi g about you to pass judgment. That is all.

    No one is above the law. Numerous warnings given…….officer handled himself in a professional manner. What a shame he was not supported and stood behind for handling everything in a legal and professional manner!

    This is too funny karma is a bitch ain’t it? Michael Kelley got what he deserved. Clearly you people don’t understand that the council man was on his knees with his hands to his side when he was tased. Therefore he was not resisting!
